General terms of sale

The physical person or corporate body who buys a cultural excursion from the company Les Visites Particulières is hereafter referred to as “the buyer” and will be considered the beneficiary of the bought service.

The general terms of sale described below define the rights and obligations of the company Les Visites Particulières and of its customers within the framework of the sale of cultural excursions. Any order thus implies the unconditional, complete and irrevocable agreement of the buyer to the general terms of sale.
An “order” is a booking requested by the buyer for which availability has been confirmed by the company Les Visites Particulières.
These terms apply regardless of any other terms of sale in any country.

The company Les Visites Particulières reserves the right to adapt or modify the general terms of sale anytime and without notice. The applicable terms are those in effect at the time of the order.

The prices of the services are the prices quoted at the time of the order. They are stated in Euros. The prices of the services include the services of a guide, the tickets for entering the places mentioned in the description (museums, monuments, etc.),transportation from place to place and booking expenses.

All our prices (which are not mentioned on our website) are stated in Euros. Invoices do not mention the VAT collected on the sold services, as it is collected on the margins only (article 266 1 E du CGI. – specific settlement for travel agencies). Prices are contractual rates. The price of the cultural excursion is not negotiable from the moment the booking request is made.

Unless otherwise specified, all excursions will start within Paris intra-muros, at the location indicated by the buyer at least 48h before the departure. The schedule is strictly programmed, and the start time will be rigorously respected. It is advised to be ready to leave 15 minutes before the start of the chosen excursion. To make sure the excursion goes smoothly, the schedule indicated by the guide shall be respected. The return time indicated on the schedule is based on normal traffic conditions. The company Les Visites Particulières will not be held responsible for any possible delays.

The company Les Visites Particulières reserves the right to adjust its prices anytime. Nevertheless, services will be invoiced at the rate indicated at the time of the order.

The company Les Visites Particulières reserves the right to adjust its program, and the choice of its service providers without notice for practical and technical reasons. For the same reasons, the order of the various places visited can be modified without notice.

The company Les Visites Particulières reserves the right to grant to the buyer discounts compared to the indicated price. No reduction will be granted once payment is due.

The reservation is registered upon reception of a reservation commitment sent by email by the client. This last confirmation is permanent and committing. The payment (bank transfer, bank or poste cheque, cash) corresponding to the price of the cultural excursion must be done before the tour.
The reservation process of a cultural excursion takes place as follows:
The buyer and the company Les Visites Particulières agree on a date and time for the chosen excursion. The buyer confirms the booking via email, which implies his payment. This booking confirmation agreed by both parties are worth sale. An invoice is sent by email to the buyer and payment makes the booking complete. Requests can be expressed by telephone, email, or by filling the form on our website.

The orders are paid as follows:
– Either by cheque
– by bank transfer
– in cash
– via Paypal

The buyer formally commits to pay the amount of the agreed upon service by any of the aforementioned means at least 5 days before the date of the excursion.

Given the requirements of the reservation of the car with chauffeur, the specialized guides and the cultural places, for any order, the total of the amount of the cultural excursion must be paid in full upon reservation.

Payment shall be cashed within the 24 hours (one working day) following the date payable.
The following is not considered as in full discharge of the debt: the use of a payment card. If payment is not made in full, the company Les Visites Particulières has the right to consider that the buyer has cancelled the reservation.


For tours not including a privatization of a museum, monument or venue :
In the case of a cancellation from the buyer less than 8 (eight) days before the start of the excursion, the total amount due must be paid in full.
Any cancellation from the buyer between 15 (fifteen) and 8 (eight) days preceding the date of the cultural excursion will require a payment of 75% of the total amount due. This does not include prepaid tickets and site reservations expenses which must be paid in full.

In the case of a cancellation from the buyer between the date of a booking and 15 (fifteen) days before the excursion, only the 150€ all inclusive application fee will be charged in addition to prepaid tickets and site reservation expenses (if applicable).

Ticket fees (admission tickets, museum reservation fees, etc.) can not be reimbursed in any case. They are due by the buyer regardless of the time of cancellation of a service.

For tours that do include a privatization of a museum, monument or venue :
In the case of a cancellation from the buyer, the total amount due must be paid in full.

Given the service requirements of the company Les Visites Particulières, it is impossible to postpone an excursion that has already been booked.

If the company Les Visites Particulières is forced to cancel a reservation, the buyer is immediately informed by email and the full amount paid by the buyer is refunded within 7 (seven) days.

Gift vouchers :
Gift certificates issued by Les Visites Particulières have a validity period mentioned on the document, generally spanning four months. The company Les Visites Particulières reserves the right to modify this period or not. After this period, the gift certificate is no longer valid and the amount of money spent will not be refunded.
In order to find a date for the realization of the service mentioned on the gift voucher, it is recommended to the customer to provide us with several possible dates to choose from, as early as possible. Indeed, the realization of a service implies to find the available partners.

Les Visites Particulières reserves the right to modify its cancellation policy on a case-by-case basis.

The risks involved during transportation of the customers are entirely covered by the insurance of the car and driver company.

In a case of force majeure the company Les Visites Particulières shall in no way be responsible for the non-execution or for the delay in the execution of any of its obligations described in the general terms of sale. A case of force majeure implies any external event, unpredictable and irresistible as mentioned in the article 1148 of the French Civil code and including in particular cases of transportation interruptions, strikes, extreme weather conditions, or fire. That is to say that in case of force majeure, the tour that had been booked will neither be refund nor postponed.

However, in the event of a strike or evacuation affecting the cultural venue scheduled for the visit, we can offer two solutions when it is possible:
– an alternative tour in the same time slot as the scheduled one (additional ticket costs may apply)
– a postponement, if the clients’ and the guide’s schedules allow it

All reservations are registered solely on the basis of the information given by the buyer or by the designated intermediary. The buyer is required to verify the details of the order. The company Les Visites Particulières declines all responsibility in the case of a reservation made on the basis of incomplete or inaccurate information. The company Les Visites Particulières reserves the right to implement penalties in the case that the customer does not respect: the general terms of sale, the visiting regulations of the places visited, the regulations of the companies providing the driver and car in which the group will be transported, as well as the rules of conduct enforced in any place that is part of the cultural excursion.

The rules of conduct mentioned above include but are not limited to :
– Appearing in proper clothes
– Respecting enforced laws
– Not consuming food or drinks in the visited places or in the car
– Not smoking in the visited places or in the car
– Respecting obligatory silence in front of works of art
– Respecting norms of politeness, not insulting the staff (guides, drives, etc.) who will accompany the buyer or the group.

The company Les Visites Particulières reserves the right to refuse access to the visit to any group whose members do not conform to the aforementioned rules.

Information and data regarding the customer are necessary for payment, for order follow up and for managing the relationship with the company les visites particulières. Data are kept in the computer database of the company les visites particulières. The automated processing of the buyer’s or customer’s personal data, and in particular email processing, has been declared to the CNIL by the company Les Visites Particulières.

In accordance with section 34 of the Freedom and Data Processing Law dated January 6th 1978, any customer has the right to access, modify, correct or delete his personal data.

To exercise this right, the customer must send a dated and signed request to the company Les Visites Particulières, complete with his address and telephone number. The request must be accompanied with a photocopy of his identity document showing his signature. The customer will receive a response within 2 (two) months following reception of his request.

If the customer does not wish to appear in the files of the company les visites particulières, this must be specified when the request is sent to the company.

Any information given by the customer to the company les visites particulières is for the sole purpose of processing orders. The company Les Visites Particulières does not communicate customer data to third parties unless authorized by the customer. In accordance with section 34 of the Freedom and Data Processing Law dated January 6th 1978, the customer has the right to access, modify, correct or delete his personal data.

It is the buyer’s responsibility to ensure that the contact information provided upon reservation is accurate and will allow him to receive confirmation of his booking. In the case that the buyer does not receive confirmation, he must contact the company Les Visites Particulières. The company les visites particulières can in no case be held responsible if the buyer does not receive confirmation of his order due to a mistake made by the buyer while entering his data.

If for any reason, one of the aforementioned terms of sale must be declared inapplicable, this does not affect the applicability of other terms, and the inapplicable term shall be replaced by another term as close to the original as possible.

Any litigation relative to the interpretation of these general terms of sale is subject to French law. In case of dispute or grievance, the buyer shall contact the company Les Visites Particulières to seek an amicable solution. If an amicable solution can not be reached, the litigation shall be carried out before the Tribunal of commerce of Paris.
